Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Ask My Lawyer website, applications, and services (the "Service"), operated by Ask My Lawyer Pty Ltd, an Australian company ("Ask My Lawyer", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Who we are

Ask My Lawyer Pty Ltd is an Australian-based platform that connects clients with verified Australian lawyers for paid video consultations. We are not a law firm and do not provide legal advice. Lawyers on the platform are independent practitioners responsible for the legal services they provide.

2. Eligibility and accounts

You must be at least 18 years old (or have legal capacity in your jurisdiction) to use the Service. If you use the Service on behalf of an organisation, you confirm you have authority to bind it. You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential.

3. The Service

We provide a platform to discover lawyers, book consultations, exchange documents, and conduct video sessions. We do not guarantee that any particular outcome will be achieved. The Service may evolve, and features may be added or removed.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Send spam, malware, or attempt to interfere with the Service's security.
  • Probe, scan, scrape, or reverse-engineer any part of the Service.
  • Infringe the intellectual property or privacy rights of others.
  • Impersonate any person or misrepresent your affiliation.

5. Payments — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, applicable taxes, cancellations, and refund mechanics are governed by the Paddle Buyer Terms. Consultation fees are charged at the time of booking. See our Refund Policy for details on refunds.

6. Lawyer–client relationship

Any lawyer–client relationship is between you and the individual lawyer you consult with. Ask My Lawyer is not a party to that relationship and is not responsible for the legal advice given. Lawyers are responsible for complying with their professional, regulatory, and trust-account obligations.

7. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Ask My Lawyer Pty Ltd or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of content you upload, and grant us a limited licence to host and process it solely to provide the Service.

8. Confidentiality

Information shared with a lawyer through the Service is treated as confidential. We maintain technical and organisational safeguards to protect that information; see our Privacy Policy.

9. Service availability

We aim to provide a reliable Service but do not guarantee that it will be uninterrupted, error-free, or available at all times. Maintenance, outages, and third-party failures may affect availability.

10. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. We exclude all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability arising out of or in connection with these Terms is capped at the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability where it cannot be limited by law (including under the Australian Consumer Law).

11. Indemnity

You agree to indemnify Ask My Lawyer Pty Ltd against claims arising from your misuse of the Service, your content, or your breach of these Terms.

12. Suspension and termination

We may suspend or terminate your access at any time for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may close your account at any time. On termination, your right to use the Service ends; we may retain data as described in the Privacy Policy or as required by law.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction over any disputes, subject to any non-excludable consumer rights you may have in your jurisdiction.

14. Changes

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.
